The BAM Map has discovered a public takedown. BAM Franchising, Inc. filed a copyright complaint with Cloudflare against bamopsmanual.com, the site that publishes the Bricks & Minifigs operations manual, and it is recorded in the Lumen Database, the public archive of copyright and removal notices. It is signed by Matthew McNeff, the company’s chief operating officer. Because it is a notice under the Digital Millennium Copyright Act, it is sworn under penalty of perjury. It is the first thing BAM has sworn about the manual since the manual appeared, and it authenticates it.
The statement in the notice reads:
This is a copy of our private and proprietary franchisee owners manual, it is not intended for public access, as is acknowledged by the site “Its cover states that it is intended for franchise owners only” (https://bamopsmanual.com/standards).
The original document resides in our internal Google Drive, and is not accessible to the public.

A DMCA notice carries an oath. The person filing it swears, under penalty of perjury, that he is authorized to act for the owner of the copyright he says is being infringed. Matthew McNeff swore that oath, and his awareness of that penalty. The notice he swore to names no copyright: in the record the kind of work is listed as “Unspecified,” and the field for the original copyrighted work records that none was submitted. He swore he was authorized to enforce a right the filing never identifies. The oath established one thing, and it was not a copyright. It established that the manual is BAM’s. BAM moved to erase the document, thereby inexplicably confirming its provenance under oath.
This is the second time in a week BAM has moved to bury material about its own operations. The first came days earlier: an anonymous, unsigned objection to this reporting, which the BAM Map published. That one could be read as bluster; an unsigned complaint proves nothing about who stands behind it, or whether the document is even theirs. This one is sworn, and it is signed by a named officer of the company. An anonymous letter can be disowned. A sworn one cannot.
In the first takedown, ‘BAM Franchising, Inc. and/or the applicable BAM entity that owns the copyrighted materials’ demanded the removal of an archive of BAM’s Freshdesk franchisee support portal, calling it proprietary, ‘BAM-created’ content. That same portal is still public, with no login, on BAM’s own hosting.

A takedown is meant to remove a work and assert a right. This one asserts no right the record can find. To take the manual down without going to court, BAM had one instrument, and that instrument runs on an oath. So to suppress a document it calls private, a named officer of the company swore, in public, that the document is genuine and its own. That oath, filed under BAM’s own name, is now part of the public record it objects to.
