BAM sent The BAM Map a cease and desist letter

CONFIRMEDIn writing, BAM asserts that it created and owns the franchisee support-portal articles, instructional graphics, and operations manual this site has reported on. CONFIRMEDThe U.S. Copyright Office public record shows no registration for any of the works the letter names.

The BAM Map has received what appears to be a legal threat from “BAM Franchising, Inc. and/or the applicable BAM entity that owns the copyrighted materials identified below.” The anonymous sender demands The BAM Map immediately take down dozens of its own pages, and hand over the names of the people who supplied it. It is not clear if it is even a real legal demand. This threatening message was received from legal.team@bricksandminifigs.com and does not appear to be from a lawyer or a law firm.

Corrections and right of reply have been open on this site since it launched, and some have been requested and made. No one had ever used the line to demand anything, until BAM. What BAM sent was not a correction. It was a claim of ownership over the operations content this site reports on.

Bricks & Minifigs neglected to respond via the right of reply form until July 28. The message does not claim that anything posted on The BAM Map is false or misrepresentative in any way, simultaneously demanding the material be immediately removed, thereby inexplicably corroborating its authenticity.

  2. Preserve all evidence relating to the acquisition, receipt, copying, uploading, publication, and distribution of these materials, including source files, communications, upload records, access logs, account records, and the identities of all persons who provided or published the materials.
  3. Confirm in writing that the identified materials have been removed and preserved.

This notice concerns the unauthorized reproduction and distribution of BAM-owned expression and materials. It is not a demand to suppress legitimate criticism, independently created commentary, or lawful reporting based solely on public records.

What the letter confirms

The letter, sent on behalf of “BAM Franchising, Inc. and/or the applicable BAM entity,” calls the materials “BAM-created”: its “franchisee-support portal,” its “support and training articles,” its “instructional graphics.” The subject of this site is how much control BAM keeps over stores its own contract requires their owners to call independent. A signed assertion by BAM that it authored and owns the operations content is not a correction of anything published here. It is confirmation, in BAM’s own hand. Every document BAM claims in the letter, BAM has now vouched for as authentic and its own.

What the letter concedes

In its own words, the letter “is not a demand to suppress legitimate criticism, independently created commentary, or lawful reporting based solely on public records.” That is the line the Copyright Act already draws. 17 U.S.C. § 107 protects use “for purposes such as criticism, comment, news reporting.” BAM and the statute agree.

What a copyright owner does, and what this was

A company that owns a copyright and wants material removed has a defined way to do it. It runs through the host, under the takedown procedure of the Digital Millennium Copyright Act, 17 U.S.C. § 512, and a valid takedown request must carry a signature and a statement, made under penalty of perjury, that the sender is authorized and holds a good-faith belief the use is not permitted by law, fair use included. Lenz v. Universal Music Corp., 815 F.3d 1145 (9th Cir. 2016). Substantial compliance means all of it, not some. Perfect 10, Inc. v. CCBill LLC, 488 F.3d 1102 (9th Cir. 2007). This is none of it. It is not a takedown request to the host at all. It arrived on July 28, 2026, through the same open submission line this site keeps for corrections, from a general “Bricks & Minifigs Legal Team” address rather than from counsel. As received it carries no signature, names no individual, and will not say which company owns the works.

What it asks for that a letter cannot get

Alongside removal, the letter demands the “identities of all persons who provided or published the materials.” A letter compels no one’s identity. Only a court can, in a filed case, and a copyright case cannot be filed until the Copyright Office registers the work. 17 U.S.C. § 411(a); Fourth Estate Pub. Benefit Corp. v. Wall-Street.com, LLC, 586 U.S. 296 (2019). Registration means depositing a copy of the work with the Copyright Office, where completed-registration deposits are open to public inspection. 17 U.S.C. §§ 408, 705. A federal court has held that submitting materials to the Copyright Office without redaction opens them to public inspection. Siegler v. Sorrento Therapeutics, Inc., No. 3:18-cv-01681 (S.D. Cal. 2019). A search of the Copyright Office public record shows no such registration. In the meantime, what is left is a request that the reader name the people who supplied the material. It will not be answered.

Whose pages these are

This site is independent. It is not owned by, operated by, or affiliated with BAM. It cites and links its sources, BAM’s own filings and materials among them. The letter also lists pages that are not on this site, at a different domain; a demand addressed to thebammap.com does not reach the pages of another website.

The ledger

For more than a month the record on this site invited correction from BAM, from the franchisor, and from their counsel. The invitation went unanswered. It has now been answered, by a claim of ownership over the material and a request for the names of the people who supplied it. The first is reported above. The second will not be answered. The letter is now part of the record it objects to.
