This is the plain-language version of the cited update, written to be read out loud. The disclosure document is a public government filing, the manual pages are posted at bamopsmanual.com, and both are quoted exactly. Nothing here is a court ruling, and everyone named is presumed to have acted lawfully.

Before you buy a franchise, the government makes the company hand you a disclosure book, and one page of that book, Item 10, is about money and loans. BAM’s page is two sentences saying, three ways, that the company stays out of it: no financing, no help getting financing, no guarantees. The company’s own manual tells a different story. Its money chapter says owners hit tough times, that the franchise “has developed relationships with many quality providers” for owners who need cash, and that the company has watched its own owners borrow their way into personal financial harm. The denial is in the filing. The help is in the rulebook. The rulebook came first.

Two sentences, three denials

Here is the entire loans page of BAM’s 2025 disclosure book: “We do not provide direct or indirect financing and do not assist in providing financing for you. We do not guarantee any notes or financial obligations.” Three denials. No financing, no assistance, no guarantees. It was not always written that way. Back in 2012 the same page said the company “may assist franchisees in obtaining financing in the future.” So the company knew the word assist. It wrote that word on this page itself, and then, over the years, wrote it out.

What the manual says when nobody is buying

A disclosure book talks to buyers. A manual talks to owners after they have signed. And BAM’s manual, in the section actually titled Investment and Financing, says this: life changes, and you might need “an infusion of cash to help get you through tough times.” Then it says the franchise “has developed relationships with many quality providers that may be available and/or fit your needs.” That is the company saying, to its own owners, that it keeps a set of money providers on hand for them. The same section adds something else: “We have seen unfortunate situations where a store owner borrows too much to pay back,” leading to financial harm for the business “and also themselves personally.” The company has watched its own owners borrow too much, and it says so, in the same chapter where it points them to its providers.

Which was written first

The manual’s cover says version 10.6.24, which is October 6, 2024. The disclosure book saying “we do not assist” was issued March 31, 2025, about six months later. So the company described its financing-provider relationships in its own rulebook first, and then filed a document with the government saying it does not assist with financing. And this is the second half of the same page to have that problem. The first half, “no direct or indirect financing,” already has a documented answer: the company’s own audited books show it sold a store and financed the sale itself with a $45,000 note, and its own signed court filing describes the loan paperwork. Why a loans page matters

Item 10 exists because a person deciding whether to buy a franchise needs to know how money really works inside the system: who lends, who profits from the lending, who steers you to which lender. A page that says none of that happens here, when the company’s own manual keeps a list of providers and its own books show a loan, is not telling the buyer how money really works inside the system. Maybe there is an innocent reading; the company is welcome to give it. Both documents are quoted exactly, and both are the company’s own words.
