BAM settled with the Mansell family on August 19 and published three documents about it: a joint statement, a FAQ, and a wire release. None of the three contains a confidentiality clause, a non-disclosure obligation, or a non-disparagement term. And the man BAM paid is booked to talk about the settlement on camera.
CORROBORATED Three planes, none of them ours: all three of BAM’s own settlement documents, archived and hashed by this site on publication day, are silent on confidentiality; the one affirmative speech term they contain runs the other way, obligating the Mansells to provide records and testimony to BAM; and the reporter BJC announced on stream, the same day, that Bryan Mansell has agreed to appear and discuss the settlement. A man bound to silence does not book the interview.
What the published settlement contains
Gives up legal claims. The Mansells “release all legal claims against BAM, its leadership…” It bars suing. It does not bar speaking.
Not in any published document
Bars saying negative things about the other side, true or not. Appears nowhere in the statement, the FAQ, or the wire release.
Not in any published document
Bars disclosing facts or terms, most commonly the amount. Appears nowhere in the three documents either. The amount is the one fact BAM withheld from its own pages, and nothing BAM published seals it.
“You’ll be able to hear his words directly, because he has agreed to come on my channel sometime this week or maybe next week to talk about this.”
The settlement’s only published speech obligation points at BAM: the Mansells “agreed to provide relevant records and testimony in support of BAM’s claims.” Nothing published obligates silence toward anyone else. What Bryan Mansell knows, first-hand, and no page of BAM’s record contradicts his standing to say: what the collection was, what the store told him, what the police file holds, what the settlement paid, and what it felt like to be sworn into a racketeering complaint by the company that has now apologized to him, unqualified.
